Terms of Service

These Terms of Service ("Terms") govern your use of products, websites, and services operated by BaseOrbit ("we," "us," "our"), including but not limited to the Saravi Flow application ("the App") and the baseorbit.ai website ("the Site").

By accessing or using our products, you agree to be bound by these Terms. If you do not agree, please do not use our products.

1. Acceptance of Terms

By creating an account, accessing, or using any BaseOrbit product, you confirm that you have read, understood, and agree to these Terms. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the App or email where practical.

2. Eligibility

You must be at least 13 years old to use our products. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian. By using our products, you represent that you meet these requirements.

3. Account Registration and Security

To access certain features, you must create an account using a supported sign-in method (currently Google Sign-In; Sign in with Apple will be available on iOS). You are responsible for:

Maintaining the security of your account credentials
All activity that occurs under your account
Notifying us promptly at support@baseorbit.ai if you suspect unauthorised access

We are not liable for any loss resulting from unauthorised use of your account.

4. Acceptable Use

You agree not to:

Use our products for any unlawful purpose or in violation of any applicable laws
Attempt to interfere with, disrupt, or compromise the integrity or security of our services
Reverse engineer, decompile, or disassemble any part of our software
Use automated scripts, bots, or scrapers to access our services
Upload content that is illegal, abusive, threatening, defamatory, or that infringes on the rights of others
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Attempt to access accounts, data, or systems belonging to other users

We reserve the right to suspend or terminate accounts that violate these terms.

5. User-Generated Content

Our products allow you to create and store personal content, including but not limited to: reflections, journal entries, check-ins, practice logs, and conversations with AI features.

You own your content. We do not claim ownership of content you create within our products. We access your content solely to provide, maintain, and improve the services you use.

By using our products, you grant us a limited, non-exclusive licence to store, process, and transmit your content as necessary to provide the service. This licence terminates when you delete your content or your account.

6. AI-Generated Content

Our products include AI-powered features (such as the Saravi AI companion, quest generation, and progress reports) that generate personalised suggestions and responses.

Important disclaimers:

AI-generated content is provided for informational and self-reflection purposes only
AI responses may be inaccurate, incomplete, or inappropriate despite our best efforts to ensure quality
AI-generated content does not constitute professional medical, mental health, financial, legal, or any other form of professional advice
You should not rely on AI-generated content as a substitute for professional judgement or consultation
We are not liable for actions taken based on AI-generated content

7. Health and Wellness Disclaimer

Saravi Flow is a personal productivity and self-tracking tool. It is designed to help you reflect on your daily activities and life balance. It is not a medical device, therapy tool, or mental health service.

If you are experiencing a mental health crisis, emotional distress, or any medical emergency, please contact local emergency services or a qualified healthcare professional immediately. The App includes crisis resource prompts as a safety feature, but these are informational referrals, not direct services.

8. Intellectual Property

All intellectual property rights in our products — including but not limited to software, design, branding, logos, text, and documentation — are owned by BaseOrbit or its licensors.

These Terms do not grant you any right to use our trademarks, logos, or brand elements without prior written permission.

Open-source components used in our products are subject to their respective licences.

9. Data and Privacy

Your use of our products is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using our products, you consent to the data practices described in the Privacy Policy.

We use Google Cloud infrastructure for authentication, data storage, and hosting. AI features use Google's Gemini API for processing. Your data is handled in accordance with both our Privacy Policy and the respective provider terms.

10. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted, error-free, or secure access at all times. Our products are provided subject to:

Planned maintenance and updates (we aim to minimise disruption)
Potential downtime due to factors beyond our control (third-party service outages, network issues)
Feature changes, additions, or removals as we evolve the product

We will make reasonable efforts to communicate significant changes in advance.

11. Fees and Payments

Saravi Flow is currently offered free of charge during the beta period. We may introduce paid features or subscription tiers in the future.

If we introduce paid features, pricing and payment terms will be clearly communicated before any charges apply. No charges will be made without your explicit consent.

When paid features are available through app stores (Apple App Store, Google Play), those purchases are subject to the respective app store's terms and refund policies.

12. Termination

By you: You may stop using our products and delete your account at any time. Account deletion permanently removes your data from our systems.

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or if required by law. We will make reasonable efforts to provide notice before termination, except where immediate action is necessary to protect other users or the integrity of the service.

Upon termination, your right to use our products ceases. Provisions of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, and limitations of liability) will survive.

13. Disclaimers

Our products are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our products will be uninterrupted, secure, or error-free, or that any defects will be corrected. Use of our products is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by applicable law, BaseOrbit and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising out of or in connection with:

Your use of or inability to use our products
Any content generated by AI features
Unauthorised access to or alteration of your data
Any third-party conduct or content

Our total aggregate liability for all claims arising from these Terms or use of our products shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹5,000 INR, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless BaseOrbit and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of our products.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our products shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

Before initiating formal dispute resolution, we encourage you to contact us at hello@baseorbit.ai to attempt informal resolution.

17. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify you through the App or by email.

Your continued use of our products after changes take effect constitutes your acceptance of the revised Terms.
